Consider a familiar case. A sign reads, “No vehicles in the park.” A man in the park has a heart attack. An ambulance is needed. Does its entry violate the rule? Most people would say that the rule was not meant to apply to needed ambulances. It would not make any difference if the rule read, “No vehicles whatsoever in the park.” The purpose of any rule against vehicles would not be served by a flat prohibition of ambulances. Consider a (...) second case. A child comes to the park on a tricycle. Is he barred from entering? A tricycle is a vehicle. But is it the kind of vehicle the author of the sign had in mind? He may only have wanted to preserve the park from fast or noisy vehicles. The purpose of the rule again becomes crucial. Is the purpose to maintain quiet and security, or is the purpose to assure absolute tranquility? The prohibition of the tricycle will depend on what purpose is accepted. (shrink)

Functionally, religion is what is held as sacred, that is, as untouchable. In the United States, taxes and military manpower are untouchable and, therefore, beyond objection by particular religions. The courts, too, are untouchable in determining what is and what is not religion. Despite these severe limitations on religious freedom, sometimes religion has broken the national consensus - most notably in the abolitionist movement of 1829-1865 and in the civil rights movement of 1959-1964. Born in Granada, April 30, 1901, Antonio De Luna was educated in the universities of Granada and of Madrid, continued his studies at Freiburg in Bresgovia, Paris, and Oxford and received the doctorate in law from Bologna. At the age of 27 he was appointed to the chair of natural law at the University of La Laguna in the Canary Isles, and from there went on to Salamanca and Granada. At this time he began a period of intense professional activity: He was Secretary of the Federation of Spanish Associations of International Studies (1932–1936), founder and director of the Institute of International and Economic Studies (1932–1936), and Secretary of the Juridical Assessory Commission of the Spanish Republic (1931–1934). Potts Jr. (bio)In December 1997, the Institute of Medicine (IOM) released a report on medical and ethical issues in the procurement of non-heart-beating organ donors. This report had been requested in May 1997 by the Department of Health and Human Services (DHHS). We will here describe the genesis of the (...) IOM report, the medical and moral concerns that led the DHHS to sponsor it, the process of producing it, and its conclusions. The analyses, findings, and recommendations of the report are also reviewed, in particular the central issues that led to suggestions for policy changes.Transplantation BackgroundAs a first step, some background in the relevant aspects of organ transplantation will prove useful. For the purposes of this analysis, “transplantation” involves the transfer of cells, tissues, or solid organs from one human to another to replace the structure or function of comparable body components that, through injury or disease, are defective or of inadequate function. The IOM report deals with solid organs, primarily kidneys and livers, whose blood supply is reconnected in the organ recipient, in contrast to cells, like bone marrow, and tissues, like corneas. A variety of donor types exists for organ transplantation, each with particular medical and scientific conditions.Living donors are healthy (and usually genetically related) individuals who volunteer to provide either a whole, paired organ such as a kidney or a section of an organ such as a liver. Cadaver donors are individuals who have died and from whom a full array of organs can be taken. “Heart-beating” cadaver donors are individuals who have suffered “brain death,” that is, irreversible cessation of function of the whole brain including the brain stem; and “non-heart-beating” donors (NHBDs) are individuals who are ill or injured, but not “brain dead,” and who have suffered cardiopulmonary death, that is, irreversible cessation of cardiac and respiratory function. NHBDs can be “controlled,” which means that [End Page 83] they can be sustained by artificial life support systems until a medical and family decision is made to terminate futile life support. This can be done at a scheduled time and in a controlled manner, and organs can then be recovered for transplantation. NHBDs can also be “uncontrolled,” which means that their hearts and breathing have stopped through disease or injury at an unexpected time or in an uncontrolled manner, and they cannot be resuscitated; the organs of some individuals of this description can be recovered for transplantation. The IOM report focused on both controlled and uncontrolled NHBDs and on problems specific to them.The questions that were asked and addressed in the IOM report became current and salient beginning in 1992 with the establishment of the University of Pittsburgh “Policy for the Management of Terminally Ill Patients Who May Become Organ Donors After Death.” This policy addressed controlled NHBDs and the ethical questions raised by their use; much of the discussion was reported in the June 1993 special issue of the Kennedy Institute of Ethics Journal. This paper examines the divergent arguments of four authors who have written about Church teaching on slavery: Pope Leo XIII, Fr. Joel S. Panzer, Judge John T. Noonan Jr., and Fr. John Francis Maxwell. It considers the statement on slavery in the (...) Catechism of the Catholic Church in light of Pope John Paul II’s meditation on the nature of human labor in Laborem exercens, itself a meditation on Leo’s Rerum novarum (On the Condition of Labor), and offers a critique of the position that papal teaching, because it must be self-consistent, is therefore irreformable or unsusceptible to development. Material acquisition—buying, inheriting, being given—and nonmaterial—learning a word, assimilating a form—have been likened, and in both, meaningful acquisition cannot take place without a taxonomy, a scheme of categories into which the acquired element can be fitted. Then with these elements—both material and nonmaterial—we create a world or build and project a self, the painter and the interior decorator equally manipulating the elements in a vocabulary. The coarseness of such an outlook seems to bludgeon away long-established fine distinctions. We need not (...) deny, however, that there may be a kind of "indifference" in regard to "the real existence of the thing" which allows us "to play the part of judge in matters of taste," as Kant would have it,1 we need not deny the existence of an "aesthetic attitude: it is just that such indifference and such an attitude probably don't have much to do with our day-to-day experience of artifacts and perhaps needn't. The "aesthetic attitude" was not long ago defined by Jerome Stolnitz as "disinterested and sympathetic attention to and contemplation of any object of awareness whatever, for its own sake alone."2 Stolnitz is at pains to distinguish the aesthetic attitude from "interests" with which it may be preferable to confuse it. "One of them," he writes, "is the interest in owning a work of art for the sake of pride or prestige". FRANCIS HERBERTBRADLEY (1846-1924) 1 agreed with the other English idealists that the real world is the experienced world. But he started with the fundamental conviction that "experience" is more than "thought," as Green had maintained. Bradley's basic drive is the refusal to abolish "feeling" in favor of knowledge and intelligibility. "Feeling" is a fundamental and (...) ineradicable aspect of "reality"m more fundamental, in fact, than thinking. In the immediately experienced world, all intelligible distinctions and relations are merged in a "whole of feeling" which is the ultimate subject-matter of philosophy. "Thought" arises out of feeling, out of "immediacy," as an interpretation of immediate experience by distinguishing relations and aspects in it. "Knowledge " is only one aspect of the experienced world; it needs blending with "feeling" and will to include all the experienced aspects. "Feeling" starts for Bradley, in his Principles of Logic (1883), in pretty much the empiricist sense, as isolated sensations, and as subjective (in flavor at least). It then becomes neutral: "feeling" is identified with "the felt"; and it grows richer, attempting to include the whole wealth of immediate experience. Thus Bradley gets very close to Dewey's conception of "direct experience," "non-reflective experience," without, however, Dewey's biological analysis. It is through this conception of experience that Bradley approaches the naturalism to which his thinking almost arrived at the end. Thought, that is, has a setting in experience " it is relational, and by its analysis it breaks up experienced and felt wholes. There is a double insistence in Bradley. On the one hand, reality is experienced, but is not adequately expressed in thought. On the other, reality/s accessible to knowledge. The real, experienced world is never identical with the intelligible world, yet it is also never "extraneous " to it. The relation of the two can be said to be, in Aristotelian terms, that of substance to form, that of what is to its intelligible aspect. The intelligible world, the system of science and knowledge, thus fundamentally needs criticism in the light of its setting in the experienced world. This is not only the entire drive of Dewey's Experience and Nature; it is the expression of that whole current of thought on the Continent which began with the criticism of Hegel's "panlogism" in the 1840's and is today called "Existentialism." Bradley is the British counterpart of all those who have criticized philosophies of logical structure like T. H. Green's, or like the other contemporary forms of Neo-Kantianism in Germany and France. The "known world" is a world of relations distingflished in the richer "real world." These distinctions are ultimately relative to their particular setting, but in that setting they are valid enough. Bradley's celebrated doctrine of the "degrees of truth and reality" means that practically knowledge is "true"; any idea which fulfills its purpose of rendering some portion or aspect of experience intelligible and significant and meaningful, and which is not ousted by a better idea, Bradley is willing to say is "so far true." In ‘An Almost Absolute Value in History’ John T. Noonan criticizes several attempts to provide a criterion for when an entity deserves rights. These criteria, he argues are either arbitrary or lead to absurd consequence. Noonan proposes human conception as the criterion of rights, and justifies it by appeal to the sharp shift in probability, at conception, of becoming a being possessed of human reason. Conception, then, is when abortion becomes immoral.The article has an historical and a (...) philosophical goal. The historical goal is to carefully present the probability argument in a charitable manner. The philosophical goal is to offer a unique criticism of Noonan's probability argument against abortion. I argue that, even on a very charitable reading of Noonan's argument for the conception criterion, this criterion is also susceptible to charges of arbitrariness and absurdity. Noonan's claim that probability shifts have anything to do with the moral rights of fetuses cannot be made coherent. I also show that there are problems with Noonan's assumptions about moral rights and the potential to become a being possessed of human reason. (shrink)

The editor has arranged forty-nine essays on and by Santayana into eight chapters representing major areas of Santayana's thought such as "Materialism and Idealism," "Essence, Substance, and Existence," "Art and Beauty." The essays supposedly speak to their chapter titles and to each other to create "the sense of dialogue"; with a few exceptions they were not written as deliberate conversation. This "dialogue" treats the reader to a fine display of the variety of minds and interests at work in philosophy and (...) illustrates the fact that one man's philosophical arena is rarely another man's. From J. H. Randall, Jr. to John Crowe Ransom, a recurring point of contention is Santayana's conception of Essences and their relationship to Matter. The range of interpretation on this issue goes from plaintive objections that "Essences don't do anything!" to appreciative acknowledgment that "Essences don't do anything!". Arguments over "isms" abound; realism, idealism, epiphenominalism are examined from many angles besides Santayana's. Santayana is highlighted nicely, arranged in this way beside his critics. His ability to locate the vital force behind an idea and to indicate where specific thrusts of thought will lead evinces his title of philosopher and master critic. John Taurek has argued that, where choices must be made between alternatives that affect different numbers of people, the numbers are not, by themselves, morally relevant. This is because we "must" take "losses-to" the persons into account (and these don't sum), but "must not" consider "losses-of" persons (because we must not treat persons like objects). I argue that the numbers are always ethically relevant, and that they may sometimes be the decisive consideration.

I argue that the most promising approach to understanding J.J. Gibson's "affordances" takes affordances themselves as ontological primitives, instead of treating them as dispositional properties of more primitive things, events, surfaces, or substances. These latter are best treated as coalescences of affordances present in the environment (or "coalescences of use-potential," as in Sanders (1994) and Hilditch (1995)). On this view, even the ecological approach's stress on the complementary organism/environment pair is seen as expressing a particular affordance relation between the world (...) and the analyst. That the world is parsed in any way among events and objects, perceivers and worlds, etc., reflects equally features of certain real or possible perspectives on the world and features of the world itself. In section 1, I begin by contending that, contrary to the apparent expectations of some in the field, the bare existence of affordances is surely quite uncontroversial. In section 2, I argue that the most reasonable approach to foundational ontology is a relativistic one. In section 3, I address the claim that affordances must be ontologically complemented by effectivities for the sake of completeness, and I shall argue against that claim on grounds that I take to reflect some of Gibson's most important insights. This work will help to clarify the way affordances are to be used in the fourth and final section, where I argue that ontological work, even within special sciences, should not be merely "regional," and that the most attractive general approach to ontological questions is one that is based on affordances, rather than upon things, events, surfaces, and the like.
